Veterans who served at least one day of active military duty during wartime, or are serving now, are potentially eligible for membership in the American Legion. Members must have been honorably discharged or are still serving honorably.
Thanks to the LEGION Act (Let Everyone Get Involved in Opportunities for National Service Act) signed into law on July 30, 2019, the current eligibility period is Dec. 7, 1941 to the present, and includes the current war campaigns. Previously, there were seven declared war periods. Now there are two: the current war period dating back to World War II and another covering World War I, April 6,1917 to November 11, 2018. Merchant Marines who served from Dec 7, 1941 to December 31, 1946 are also eligible. No other restrictions to American Legion membership have changed.
